Washington Prognosis: House Appropriations Committee Sets FY 2024 Spending Levels; Appropriations Process Moves Forward
Just weeks after agreeing to raise the debt ceiling and setting appropriations levels of the next two fiscal years, House Appropriations Committee Chairwoman Kay Granger (R-TX) reversed course and officially set fiscal year (FY) 2024 funding allocations, also known as 302(b) allocations, to reflect FY 2022 levels for nondefense discretionary spending.  The move by Granger would result in a 29.1% cut from the enacted FY 2023 levels for Labor, Health and Human Services, Education and Related Agencies (L-HHS-Ed).  The 302(b) allocations set for overall nondefense discretionary spending are intended to appease Members of the House Freedom Caucus and other conservative Republicans that have been blocking a number of bills from being voted on in protest of the agreement forged by Speaker Kevin McCarthy (R-CA) and President Biden.  

The House 302(b) allocations allows the appropriations process to move forward.  However, the Senate Appropriations Committee must still set their allocations for their version of the bills and both Chambers must markup and finalize their bills before they are conferenced and ultimately sent to the President.  Under the debt ceiling deal, final FY 2024 spending bills must be agreed to by January 1, 2024, or all agencies receive a 1 percent reduction in appropriations.

 

House Education and Workforce Committee Holds Hearing on HHS Priorities 

The House Education and Workforce Committee conducted an oversight hearing to discuss Department of Health and Human Services (HHS) policies, President Biden’s FY 2024 budget request, and hear from HHS Secretary Xavier Becerra.  In her opening remarks, Chairwoman Virginia Foxx (R-NC) expressed her concerns about growing Medicaid enrollment and the number of individuals leaving the small group market for Medicaid.  

Several Committee members questioned Secretary Becerra regarding a New York Times article on the exploitation of migrant children working in factories, to which he ensured the Department of Labor (DOL) will follow-up. Additionally, members raised concerns about the care of migrant children following their release from HHS custody.   Secretary Becerra claimed that once a child is placed with their sponsor, HHS loses custody and therefore jurisdiction.  

On both sides of the aisle, members expressed concerns that Pharmacy Benefit Managers (PBMs) are unfairly raising prescription drug costs and may also be pocketing drug discounts.  Representative James Comer (R-KY) described PBMs as the “middleman,” with weaponized access to patient information allowing them to engage in self-serving practices resulting in states being overcharged.  Secretary Becerra agreed that there needs to be more transparency involved and stated he believed PBMs are raking in more money than they should.


House Energy and Commerce Committee Holds Hearing on PAHPA and Drug Shortages
The Health Subcommittee of the House Energy and Commerce Committee held a hearing to discuss its ongoing efforts to reauthorize the Pandemic and All-Hazards Preparedness Act (PAHPA) as well as the recent rise in drug shortages, specifically those that affect cancer patients.  Subcommittee Chair Brett Guthrie (R-KY), Ranking Member Anna Eshoo (D-CA), and full Committee Chair Cathy McMorris Rodgers (R-WA) urged members of the Subcommittee to consider and support PAHPA in a bipartisan manner.  Many members of the Subcommittee on both sides of the aisle agreed that passing the legislation before it lapses on September 30 was critical in bolstering the nation’s pandemic preparedness and response efforts in preparation for future pandemics.  

A select few members of the Subcommittee also highlighted the recent rise in cancer drug shortages, arguing that the scope of PAHPA should be expanded to include provisions addressing Food and Drug Administration (FDA) regulatory pathways and generic drug reimbursement rates that could limit future shortages.  While the other members of the Subcommittee, including leadership, agreed that drug shortages were a significant issue, they argued that it should be addressed in other legislation to avoid other proposed additions to PAHPA, including bans on “gain of function” research, that would erase its current bipartisan support and inhibit the legislation’s ability to move forward.


House Committee Holds Hearing with Retiring CDC Administrator Rochelle Walensky 
The House Select Subcommittee on the Coronavirus Pandemic held a hearing with the outgoing director of the Centers for Disease Control and Prevention (CDC), Dr. Rochelle Walensky.  Committee Republicans continued to press Walensky on the CDC’s decision making and messaging during the COVID-19 pandemic, focusing on school closures and her statements on the transmission of the disease by vaccinated individuals.  Walensky argued the agency made its decisions in real-time as the virus continued to mutate and that the CDC needed Congress to update its authorities.  When asked by Committee Ranking Member Raul Ruiz (D-CA) what the CDC needed to prepare for the next pandemic, Walensky argued for improved data collection and hiring authority to ensure individuals responsible for public health are more accountable to the director’s office. 

House Appropriations Committee Approves Veterans Affairs Spending Legislation
The House Appropriations Committee, on a party-line vote, approved the fiscal year (FY) 2024 Military Construction, Veterans Affairs, and Related Agencies Appropriations Bill which funds the Department of Veterans Affairs (VA) medical care, educational assistance, and research activities.  The bill would fund the VA at $363.3 billion, equal to President Biden’s FY 2024 budget request and approximately $49 billion above FY 2023 enacted levels.  In particular, funding for the Veterans Health Administration (VHA), which includes funding for nearly 1,300 health centers including 171 medical centers, and medical and prosthetic research, among other initiatives, would be funded at $138 billion, in line with the President’s FY 2024 budget request.  Increased funding for the VA and Veteran’s medical care was a major component of the bipartisan Fiscal Responsibility Act and as the appropriations process unfolds, VA funding will likely be the only major domestic healthcare program to receive a noticeable increase as House Republican appropriators seek to tie FY 2024 spending to FY 2022 levels. 

The Committee would fund the VA Neurology Centers of Excellence, which provide clinical care, education, and research efforts for neurologic conditions including epilepsy, headache, multiple sclerosis, and Parkinson’s disease at the FY 2024 President’s budget request amount of $59.5 million. This includes $23.5 million for epilepsy, $21 million for headache, $10.3 million for Parkinson’s; and $4.6 million for multiple sclerosis.  In addition, the Committee encourages the VA to expand academic collaborations, including public academic medical centers, with Community Based Outpatient Clinics (CBOC) emphasizing that through clinical traineeships and research, emerging health professionals can gain a better understanding of veterans’ healthcare needs.  The Committee would fund the Military Toxic Exposure Research Program at $68 million, equal to the FY 2024 President’s budget request, and prioritize funding for the Airborne Hazards and Burn Pits Center of Excellence, PFAS research, and service-connected colorectal cancer.

  • Overpayments to Medicare Advantage Plans Exceed $75 billion Annually: According to new analysis by the University of Southern California’s Schaeffer Center for Health Policy & Economics, overpayments made to insurers managing Medicare Advantage (MA) plans exceeds $75 billion annually, even though on a per-beneficiary basis individuals with similar risk factors enrolled in MA plans had lower expenditures than those in traditional Medicare.     
  • National Health Expenditures are Expected to Increase by More than 5 Percent Over the Next Decade: According to the recently released annual National Health Expenditures Report, national health expenditures are expected to grow by 5.4 percent between 2022 and 2031.  Highlighted in the report was the number of insured individuals in 2022 which reached a historic high of 92.3 precent between public and private insurance.
